BAD DEAL w/Bobblehead3

Ok, upfront warning: this will get pretty long, as i really want to give yo uguys the information necessary here.

Over a month ago I received a pm from bobblehead3 about my intrest in trading with him. I was in the middle of a normal Flexfit & Trucker run, everything going smoothly. He said in his inital pm that he had checked my reputation and saw the great response from my product. He was positive he wanted to deal with me. He went on to offer me two items in trade for FOUR hats. His first item was a Sirius Satellite radio unit, which he said was in full working condition. His second item was a Palm LifeDrive Mobile Manager unti. He said this was his wife's unit, but she had only had it a little over two months without hardly using it. She apparently wanted to upgrade to a new phone that could do everything this unit could. He assured me this unit was in mint condition and fully functional.

Obviously, my interest was high but I felt skeptical. So I shoot him off a pm with some questions. My questions were:
- Are both pieces of electronics "yours"?
- Are both fully functional?
- Are both in original condition, no modifications, etc

He ASSURED me that they were both items HE PERSONALLY PURCHASED, and had receipts for. He said both items were fully functional, WITH NO PROBLEMS. He did alert me that he did not have the pc install cd for the palm unit, that his wife apparently misplaced. I wasn;t overly concerned about that so i told him I would do the deal. I told him to pm me the four hats he wanted and I would send them out. A few days later he did, saying to pm him the tracking info when i sent them out and he'd ship my electronics the same day. I told him it'd be a few days but I would get them out by the end of that week.

As life is always throwing us curveballs, I got a call a day or two later that my father had been admitted to the hospital. This was not a shock to me, as he has been in and out of the hospital and ICU unit since June. After going to visit him the next day i realized that he was in a much worse condition than he had been before, both mentally and physically. He stays with his girlfriend in an apartment, and she works 10 hour shifts as a bus driver. It was apparent I would need to take some time off of work to get him settled back in once he got out of the hospital. So, after 4 days in the hospital he got out and I went to stay with him. During this time Bobblehead3 had pm'd and posted on my threads about our deal. I pm'd him back explaining the situation, and telling him I was more than willing to do the deal once i got back to work. Itold him it would take some time. So after a week off, I returned to work. I log on to find a real pushy pm from him about wasting his time, even after I had told him the situation. I wrote him back and told him I was willing to do the deal but he knew of the circumstances causing the delay, and it shouldn't be such a "problem". He wrote me back immeadiatly and said he just wanted to get the items before his tournament. I tell him I will get his hats out the next day. So the next morning I get in and log on and find a pm from him stating that he has another offer from someone else for 10 hats for the same two electronic items. (AT THE TIME I SHOULDVE CUT TIES AND BEEN DONE!). He gave me the rundown of how good my stuff looks, how great my feedback is, and how he knows i won;t screw him o nthe deal. He says if i'll do 10 it's mine. I pm hi mand tell him we already have adeal for 4, so no i won't do ten. He writes back pleading to do the deal for 7 and he'll ship it out that day. After thinking it over, and doing some math, I figure 7 aint really a bad deal on my end. I agree. I tell him his 4 hats he wanted would go out that day, and the other three the following monday (this is like wed). He says great, as he is leaving the end of next week. So i ship out to him the first 4 hats. He pm's me the next day with a tracking number saying my stuff shipped. I'm in the process of doing his other three hats, he pm's and is asking where his other hats are cuz he's got them sold already. I pm him back, reminding him of all the conversations we've had, and he remembers suddenly. I ship out the second box to him, thinking that my box should be arriving that same day or next day (he's in az and i'm in ca). Well, my box goes out and nothing comes in. I wait another day. nothing. I track package online and it says that only his electronic shipping information was received, not the package. I'm pissed now. I write him a pm asking for an explantion. nothing. I give him another two days, and as I'm writing the longest, nastiest, pm i've ever written, the box xomes in the usps delivery. I erase the pm, and forget all about it. I open up the box and find the two items he had described, only not as he described. The box the palm unit is in looked beat up and run down, although the unit itself looked pretty good. It had some small spots like someone spilt a liquid and it splashed drops on it. Nothing major really. The sirius unit looked old, definitly not new. Neither item came with a receipt.

By this time I am feeling like I got used for some janky equipment, not thinking about it working or not, just that it wasn;t as described as being new. I left the box at work that night, thinking I will check it out the next day. I end up having to stay home the next day, my wife and both daughters were sick. So i come in to work and get everything started, about midway through the day i start working on my side stuff. So i take out the palm and try to turn it on. nothing. i figure ok, maybe battery is dead. so i pull out instruction manual and it says charge for 3 hours if battery is dead. I do, and near end of day it stops charging. I figure it's gtg now and turn it on. It loads to opening screen, then freezes. I try it again, same result. Again, again, and again. nothing. I log on to palm.com and do virtual tech support chat and they walk me through a quick reset. nothing changes. the rep says i have to reset the unit back to factory settings and it'll be gtg! I follow all the steps (a 1 hour process) same result! I am pissed!!!!! I log back on to palm.com and they offer to diagnose the problem FOR FREE! Whatever the problem is, they'll fix it and re-certify it with an extended warranty for 1 year. I figure it's worth it, right? So i send it off. I get an email a few days later from palm stating that THE DEVICE IS DEFECTIVE!!!!. The Main Storage Drive and Processor were both CORRUPTED and had not had any data used or changed in over 90 days!!!! I haven;t even had the thing in my possession two weeks and their saying it's been bad for over 90 days! I'm fuming by this point, like a bull in a cartoon!!! I go straight home and call my neighbor, who has a sirius unit in his car. Heunplugs his unit, and plugs mine it. Zero. Nothing. Nada. no power even to the unit. No signal. Nothing. I get online and write bobblehead3 and ask wtf is going on here??? No response. Haven;t gotten a response. Nothing. He aint been online, he aint been on his myspace. He aint nowhere to be found. I emailed him last weekend, before I mentioned to anyone anywhere that our deal was going bad. I gave him one last chance to make it right. I told him he had 48 hours, until today, to contact me in some form. If not, on the board it went, IN FULL DETAIL. Well, obviously since I am writing this, he aint contacted me!

In the end, I'm out $175 worth of retail product and have nothing to show for it. On top of that, I was lied to (one of my biggest pet peeves!). On top of that I dealt with someone who had zero respect for my situatuion (dealing with my dad), and I let that happen. I should've set him straight right then and told him to pound salt and that he couldn't BUY my hats if he wanted to. I didn;t though, and in the end, I took the loss. No paypal to report to, no credit card to alert, no check to cancel, nothing. His name is Tre, and he is TRYING to get a new softball company going AUTOMATIC SOFTBALL, out of Arizona. I sure would appreciate my money, my product, or the product i dealt for fixed, which by the way palm estimated a $200 minimum to fix (more than the damn trade was even worth!!!)
My advice is DO NOT DEAL WITH BOBBLEHEAD3!!!

No reason to delete ANY information ..... you already made it personal by posting a NOT GTG here !!!

FAMILY ALWAYS COMES FIRST !!!!!!!!!! But, I don't think you can blame Bobblehead3 for trying to make another deal either. I really hope your DAD is fine ... nothing hurts more than losing a loved one or not being able to help a loved one, but obviously Bobblehead3 has no patients whatsoever !!

Hopefully you can get in touch with him and all this can be resolved. You obviously got something not as described !!

I agree 100 % ... no deal should ever be broken after its been made, but did you read the 'whole thread' ?? Correct me if I'm wrong, but 'sometimes life throws us curveballs' .... the way I'm understanding this is BIGG_P was away for a few days !! I guess I just looked into this as because of more important life happenings, that there was no communication (or very little).

BIGG_P is not at fault here at all ... and he defintely did not get an item as described !!
